Civil unions and the meaning of the public policy exception

Despite the initial appeal of arguments that the civil union concept is a compromise
that will be more acceptable to society than same-sex marriage, the long history of recognition of
marriage in both constitutional analysis and state statutory schemes provides a stronger
foundation for the recognition of same-sex marriages throughout the states.
 
 

Domestic Partnership

Similar to civil unions, domestic partnerships are a form of relationship that gives limited state rights to both same-sex and opposite-sex couples who live together but wish to remain unmarried or whose marriage is prohibited by law. Unlike civil unions, however, which are only legal in a handful of states, domestic partnerships are offered at either the state or city level, such as in New York and San Francisco.
